This website is owned and operated by Carla Phillips (“we” or “us”). By using the website, you agree to be bound by these Terms of Service and to use the website in accordance with these Terms of Service, and any additional terms and conditions that may apply to specific sections of the website or to products and services available through the website or from us. Accessing the website, in any manner, whether automated or otherwise, constitutes use of the website and your agreement to be bound by these Terms of Service.
We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.
All rights, including copyright, in the content of the carlaphillipsdesigns.com.au website are owned or controlled by Carla Phillips Designs. In accessing the website, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of the Carla Phillips Designs website for any other purpose whatsoever without the prior written permission of Carla Phillips Designs.
Carla Phillips Designs provides clients with consultancy advice, professional and trade recommendations, photographic and/or product examples for interior styling and furnishing concepts. However, ultimately we respect that the final choice for any creative direction, product purchase, design or colour scheme; or choice of tradespeople will be the client’s final decision.
Fees are based upon our styling expertise, the scope of the project, advisory/management needs and the time anticipated to complete the work.
One revision to the concept board is included. Additional revisions billed at hourly rate of $75. Interior Design is a subjective art and profession. Due to this we cannot guarantee that clients will always like their recommendations. Unfortunately, we cannot provide any refunds if this is the case. However, please feel free to contact us and we’ll be happy to discuss the design concepts and make further recommendations.
All payments must be received before Carla Phillips Designs commences work.
We accept payments via Pay Pal or via direct bank transfer only.
If you have purchased a service with Carla Phillips Designs but then wish to change or cancel it, please contact us as soon as possible. We will try our best to make the relevant changes but cannot guarantee as your design order may already have commenced or be completed.
To cancel an order you must inform us within 24 hours after your payment by email. Once we have received your cancellation email and confirmed that you wish to cancel an order by return email. Any sum debited to us from your credit or debit card will be re-credited to that credit or debit account within 30 days of your order.
PROJECT DELIVERY TIMELINE
Delivery of Carla Phillips Designs E-Decorating services will be 2-6 weeks of receiving payment and sent to the email address provided in your order. Whilst we aim to deliver on our services promptly and within the 2-6 week time frame, it may vary depending on the size of the project.
OWNERSHIP OF PROJECT DOCUMENTS
The schematics, plans and other documents prepared by Carla Phillips Designs for this project are Carla Phillips Designs property for use solely with respect to the Project, and shall not be used by the Client or others on other projects, except by agreement in writing. Unless otherwise provided, we shall be deemed the author of these documents and shall retain all common law, statutory and other reserved rights, including the copyright. Client shall be permitted to retain copies for information and reference in connection with the Client’s use and occupancy of the Project.
RIGHT TO PHOTOGRAPH
Client agrees to permit Carla Phillips Designs (or professional designated by us) to photograph the Project upon completion. Carla Phillips Designs will be entitled to use such photographs for portfolio and business purposes, but we shall not disclose the Client’s name without Client’s prior written consent.
Carla Phillips Designs will not pass on your personal, credit or debit card details to any third party without permission.
EXCLUSIONS OF LIABILITY
Carla Phillips Designs E-Decorating service will rely entirely upon measurements provided by the client in designing the room and furniture layout and recommending items to be purchased by the client.
It is the client’s responsibility to ensure that all measurements required are provided and that all measurements are accurate.
We will not accept any responsibility nor any liability in the event that any recommended item does not fit the space as shown on the floorplan due to the client’s failure to provide any measurements and/or in providing incorrect and/ or inaccurate measurements.
Carla Phillips Designs does not accept liability for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications and descriptions of listed products and services at any time and without notice. If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price.
Carla Phillips Designs shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control.
We care about your privacy and ensure any data collected from you is stored as securely and safely as possible. However, Carla Phillips Designs cannot be held liable in the extremely unlikely event of a breach.
GOODS PURCHASED THROUGH CARLA PHILLIPS DESIGNS
The concept designs we provide are intended as a recommendation only. Carla Phillips Designs will provide details of where to buy all our recommendations but cannot be held responsible for changes in price, stock issues and accuracy of this information.
We will happily co-ordinate all deliveries on your behalf. In doing so, you take full responsibility for any complications or issues that on the very rare occasion can occur. In the event an issue does arise, we will endeavour to resolve the issue as quickly as possible but will not take any responsibility or financial loss for any complications. We will endeavour to quote accurate delivery times, however unforeseen delays can occur. Where possible I will keep you informed of delivery dates and times, please note, this is very difficult to predict when the delivery companies are making numerous deliveries in one day. In this instance, we will keep you informed but cannot be held responsible for any delays or additional delivery fees.
Please note: **Re-delivery fees may be charged if you arrange a time with the freight company and are not able to receive the goods as initially arranged.**
If you are happy for the delivery company to leave the products at your front door or other secure area please inform me at time of ordering but we nor the delivery company can take any responsibility if the items are stolen from this location.
Due to the nature of furniture transport, complications can at times occur. If a product arrives damaged, please notify us immediately via email with photographs of the damage and make note of the damage when signing for the goods if it is visible before opening.
Warranties on all goods are as per our supplier warranties. A number of suppliers have back-to-base warranties, which means you must pay the costs of freighting the item back to the supplier for replacement.
COLOURS & MEASUREMENTS
Each computer resolution is different and as a result, we cannot guarantee that the actual colours of the products are accurate to the colour of the product in real life. That is the risk you take when ordering online. Where possible, we recommend you visit the showroom of the supplier before purchasing the items. It is up to you to ensure the suggested pieces fit within your home, building entry points and doorways, before proceeding with the order. We cannot take any responsibility should the items not fit through doorways or where intended.
EXCHANGES & REFUNDS
All products purchased through Carla Phillips Designs must be paid for in full before arranged for dispatch. Unfortunately we do not provide any refunds or exchanges for change of heart/unforeseen delays on any items as we are bound to suppliers terms and conditions.
